Statistically speaking, the majority of drivers on the roads today will have some experience with a traffic violation. These include, for example:

Speeding, Careless Driving, Reckless Driving, Improper Turn, Failure to Observe a Traffic Light or Stop Sign, Driving While Suspended, Alcohol in a motor vehicle, or Driving While Intoxicated (DWI.)

In many cases, these traffic violations have fines and Motor Vehicle Commission (MVC) points associated with them. The effect of which may be increased insurance premiums, MVC surcharges or even a period of license suspension. Some of these traffic violations may be plea bargained or reduced to a lesser offense. In such cases, the points may be reduced or eliminated entirely or the fines may be lessened.

In other circumstances, such as a DWI offense, there is a specific prohibition against plea bargaining the offense. Depending on the blood alcohol reading (BAC) and the circumstances surrounding the stop of the motor vehicle, the matter may be successfully defended. The introduction of the new breath test machine, called the Alcotest, in New Jersey has presented many challenges for the state in prosecuting DWI matters. This area of law has become a very technical and scientific battleground between state prosecutors and defense attorneys.

Under the various state and federal false claims laws, whistleblowers file suit under seal on behalf of the governments that the whistleblower believes have been defrauded by government contractors. The whistleblower's lawsuit remains under seal while government investigates the whistleblower's allegations. If the government decides to intervene in the lawsuit and join in the whistleblower's allegations of fraud, the whistleblower receives between 15 and 25 percent of all monies the government recovers as a result of the whistleblower's information.

Most recently many of the False Claims Act cases have involved fraud on the Medicare and Medicaid health programs. Fahy Choi's solid experience working with government investigators and prosecutors on different types of fraud matters has enabled the Firm to become involved in False Claims Act cases. Several members of the Firm are former state and federal prosecutors and the Firm is uniquely situated to work with government investigators and prosecutors to provide a "road map" of the whistleblower's allegations. Civil Litigation is what most people are thinking of when they read or hear about a "lawsuit".
